Liability Waiver and Release Form - Minor Child

This Liability Waiver and Release Form (“Waiver”) is entered into and effective as of the date of the last signature below by and between the undersigned participant (“Participant”) and XploreBelize Tours LTD and XploreBelize Elite LTD, including their employees, subsidiaries, subcontractors, affiliates, officers, directors, agents, and successors (collectively referred to as “Company”), with reference to the following facts:

Acknowledgment and Acceptance of Risks: The Participant, desiring to voluntarily engage in tours and activities (“Activities”) offered by the Company, acknowledges and accepts the inherent and additional risks associated with these Activities, which may include but are not limited to physical injury, illness, disability, or death. The Participant hereby agrees to waive, release, and discharge any and all claims, known or unknown, against the Company from any and all liability for injuries, death, property damage, or other damages resulting from participation in the Activities, including those arising from the negligence or gross negligence of the Company or otherwise, to the fullest extent permitted by law.

Who: The Participant, by detailing their full name below and signing this Waiver, agrees not to pursue legal action against the Company or its employees, subsidiaries, and subcontractors in the event of an accident, injury, death, or property damage occurring as a result of participating in the Activities.

What: In consideration for being permitted to participate in the Activities, the Participant understands that their participation is the exchange for the agreement contained herein, including the assumption of risk and waiver of liability as detailed.

When: This Waiver becomes effective immediately upon the Participant's signature and remains in effect indefinitely for all future Activities in which the Participant partakes, prior to the commencement of any such Activity.

Where: The Company's principal place of business is . For Activities without a fixed location, the nature and itinerary of the Activity are described in the documentation provided to the Participant upon booking.

How: The execution of this Waiver by both the Participant and the Company, including its employees, subsidiaries, and subcontractors, is not an admission of any fault, negligence, gross negligence, or wrongdoing by either party.

Medical Treatment: The Participant consents to receive medical treatment deemed advisable in the event of injury, accident, and/or illness during the Activities and releases the Company from any claim arising from such treatment, even if the treatment is due to the negligence or gross negligence of the Company.

Insurance: The Participant is solely responsible for obtaining suitable life, medical, or health insurance coverage.

Assumption of Risk: The Participant expressly acknowledges the risks, including risks arising from the Company’s negligence or gross negligence, and assumes all related risks.

Modifications: This Waiver can only be modified by a written document duly signed by both parties.

No Admission: Signing this Waiver does not constitute an admission by either party of any liability or wrongdoing.

Photographic Release: The Participant grants the Company permission to use any photographs, recordings, or any other record of the Activities involving the Participant.

Right to Attorney: The Participant acknowledges their right to consult with an attorney prior to signing this Waiver and affirms that they are signing it voluntarily.

Severability: Should any provision of this Waiver be deemed invalid or unenforceable, the remainder shall remain in effect.

Parent or Guardian Authorization: By signing, the Parent or Legal Guardian acknowledges that they have read, understood, and agreed to the terms outlined in this Waiver on behalf of the minor child, including the waiver of legal rights against the Company, its employees, subsidiaries, and subcontractors for negligence and gross negligence. The Parent or Legal Guardian affirms their authority to act on behalf of the minor child and accepts full responsibility for the minor child's participation in accordance with the terms of this Waiver.
